侵权责任 tort liability

十一届全国人大常委会第六次会议将于12月22日至27日举行，侵权责任法草案等多部法案将上会审议。此次即将进行审阅的侵权责任法草案第二条规定，故意或者过失对他人人格权、身份权、物权、知识产权及其他民事权益造成损害的应当承担侵权责任。

"The draft tort liability law is a basic law to protect people's civil rights and ensure they can get redress if their rights are harmed," the NPC's Law Committee said in a document submitted to the meeting.

全国人大立法委员会在向大会提交的文件中表示："这份草拟的侵权责任法是保护公民人权以及确保公民在权利受损时得到侵权赔偿的一项基本法律。"

在上面的报道中，tort liability就是指"侵权责任"，即侵权行为的赔偿责任。侵权责任是指民事主体因实施侵权行为而应承担的民事法律后果。

Tort的意思就是"民事侵权行为"，类似于civil wrong，例如Civil wrong against persons or property is called "torts".（针对人或财产的民事不规行为称之为"侵权"）。而joint tort就是指"共同过失"。

在这个短语里，liability意思是"责任、义务"，如：hold no liability for damages（不负赔偿责任），而且有时候这种责任是joint liability（共同责任、连带责任）。我们平时还经常用它来表示"倾向、不利条件"，比如有的人特别容易患流感，就可以说他liability to flu。此外，在经济领域它还可以指"负债"，如direct liability 就是指"直接债务"。
